1. Who we are
El Chif Music is the house for the catalog and related pages at elchif.com and such other hostnames as we publish (together, the “Site”). The performing and writing name on the catalog is El Chif. Companion books listed on /books are written by Nathan Nifco.
These Terms of Use (“Terms”) are an agreement between you and El Chif Music. By using the Site you accept these Terms. If you do not accept them, do not use the Site.
2. What these Terms cover — and what they do not
These Terms cover use of the Site: browsing, listening to excerpts we make available, reading house pages, sending a form, and following links we publish.
They do not grant a synchronization, master, public-performance, mechanical, or any other music license. A grant is a separate written instrument. Inquiry for picture starts at /licensing and /licensing/inquire. Library partnership inquiry starts at /licensing/partners.
They do not replace the purchase terms, refund rules, or platform terms that apply when you buy a book, course, or other product on its own page (including pages on elchif.com and elchifcourses.com).
A privacy notice, where published, lives at /privacy.
3. The catalog is not a free library
All music, scores, stems, artwork, text, marks, and video on the Site are owned by El Chif Music or used under license. Est. 4464 and the wax-seal mark are house marks.
You may stream or play excerpts on the Site for personal evaluation only, as the player allows. You may not download, copy, rip, sample, train a model on, redistribute, publicly perform, synchronize to picture, or commercially exploit the catalog unless a written grant from El Chif Music says you may.
“Royalty-free,” “copyright-free,” and similar phrases do not apply to this catalog. Flagship titles remain with the house except as a written grant provides.
4. How a license is granted
A brief submitted through /licensing/inquire is a request, not a grant. We may send a shortlist, decline, or ask for more. No license exists until El Chif Music issues a written grant that names the work, the use, the territory, the term, and the fee.
Do not place a cue in a cut, a trailer, an advertisement, a game, or a library on the strength of a player embed or an email alone.
5. Books and courses
Titles on /books (including The Harmony Code, Waves and Words, and The Clarity Code) are writings. Opening a book URL takes you to that title’s own page or to a third-party checkout. Purchase, format, and fulfillment follow that page.
The 12 Pillars of Harmonic Wellness is a compositional and written framework. It is not medical, psychological, or therapeutic advice and is not a substitute for licensed care.
6. Accounts, forms, and what you send us
You are responsible for the accuracy of anything you submit (contact forms, briefs, partner inquiries, newsletter fields). Do not send material you do not have the right to send. Do not send confidential third-party scripts or unreleased picture unless you are authorized to do so.
We may keep submissions as needed to answer you and to administer a grant. We are not obliged to accept, shortlist, or return materials.
7. Acceptable use
You may not:
- interfere with the Site, scrape it aggressively, or probe it for vulnerability except as the law allows;
- impersonate El Chif Music, El Chif, or Nathan Nifco;
- use house marks or cover art to suggest a partnership we have not granted;
- use Site content to train or improve a machine-learning system without a written grant that says so;
- frame the Site so that it appears to be another service.
8. Third-party sites and players
Links to distributors, course hosts, payment pages, and social platforms leave our Site. Their terms and privacy rules apply there. An embed does not enlarge your rights in the work.
9. Disclaimer
The Site is provided “as is.” To the fullest extent the law allows, El Chif Music makes no warranty that the Site will be uninterrupted, error-free, or fit for a particular production deadline. Evaluation players are for listening, not for delivery of masters.
10. Limitation of liability
To the fullest extent the law allows, El Chif Music is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Site. Our aggregate liability for claims arising out of the Site is limited to one hundred Canadian dollars (CAD $100), except where the law does not permit that limit. This clause does not limit liability that cannot be limited (including certain liability for fraud or for personal injury where the statute requires).
A paid license, book, or course may have its own written cap; that instrument controls for that purchase.
11. Indemnity
You will defend and indemnify El Chif Music and Nathan Nifco against claims arising from your misuse of the Site, your unauthorized use of the catalog, or your breach of these Terms.
12. Changes
We may update these Terms by posting a new version on this page and changing the “Last updated” date. Continued use after that date is acceptance of the new Terms.
13. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Courts in Vancouver, British Columbia have exclusive jurisdiction, except that El Chif Music may seek injunctive relief in any forum to protect the catalog and the marks.
